Are you obligated to pay a new owner for damages to a mailbox?
Basically, I just got this call from my frantic younger brother this morning. About a year ago, him and his pals accidentally took out a mailbox with a golf cart. According to him, his friend who was neighbors with this person went over and apologized. These people said it was okay and that mistakes happen. They also said that they had the house for sale so they really weren't too concerned about it. Anyways, fast-forward a year and the new owners have contacted my brother and his friends and want them to pay the pretty exorbitant fee of $400 (a lot of money for a 13 year old).... Are my brother and his friends legally obliged to pay this? I assume since it's a new owner that they don't really have any rights to make them do so... How should we handle this?
they cant make him pay because they did not own the property at the time of the damage.
explain to them that due to them not owning the propety at the time they cannot hold him liable and they purchased the property with the damaged mailbox therefor it is their responsibilty not your brothers.
